社群主义正义观的理论逻辑与内在张力探析

Abstract

自20世纪70年代起,约翰·罗尔斯的《正义论》(1971)以“原初状态”理论重构社会契约,挑战功利主义霸权,为自由主义奠定规范性基础。然而,其“权利优先于善”的范式在应对资本主义危机时暴露局限,社群主义作为批判性回应,提出“构成性自我”与“共同善”框架,强调正义须根植于社群实践与历史语境。本文通过本体论与方法论视角,结合儒家伦理等非西方思想,揭示自由主义普遍主义的局限,并探讨社群主义正义观的理论逻辑与实践价值。
